Dropping Equipped Weapons on Death

Sorry if this has been asked before, I can't seem to find it if it has.

I remember when I first started playing the game (back in June of last year) a friend of mine died and said she dropped her Tarbar, I also remember that I witnessed my husband die and drop a weapon when he was leveling outside of Elven Village.

Then sometime a few months ago there was an arguement in the clan I was in about wether or not it was possible to drop an equipped weapon upon death (when your name isn't red) when you die to a mob/npc (such as a guard).

So yes, basically my question is that: Can you drop your equipped weapon upon death when your name isn't red?
Not when it's equipped. If it does, make a petition.... because you will get it back, as it's not supposed to happen.
This was changed ether in C2 or C3. Now you can not drop equiped wearpon unles you are red with 5+ PK's.
It is not supposed to happen. It does occasionally anyway. When it does, you are supposed to be able to get your weapon back by a petition, but.. A friend of mine dropped his dragonslayer this way, and did not get it back.

I've been thinking, if you drop it, while still dead, open your inventory and take a screenshot. I dont think you can unequip weapons when dead, so your empty weapon slot should show you dropped the weapon on death.
There is a system message when you drop things on death - simply screenshot that, I suppose.
Better keep inventory open too, so they can see the empty weapon slot.

There have been a couple official posts of Spam and Mistryl, stating, that your equipped weapon dropping, while you are NOT red OR have less than 6 PK, is a bug and should be reported.

So yes, I am still sure.
