There is a guy in Bartz who frequently breaks the EULA in ways that I'm not going to disclose and he has admitted to doing so in a few mails to my clan leader. I, as many other players, hate the people who engage in these activities.
Every time I see him I report him to a GM and then proceed with Killing him when he is AFK. Today he logged many of his characters to try and fight back, but failed, after which I sent him a mail telling him: "You have brought this onto yourself for breaking the EULA and I will keep killing you for I am Justice" so as to discourage him from coming back to fight.
I came back from work and found a mail from him saying that he is suing me because I'm "stalking" him and "harassing" him. He is "officially" warning me to stop killing him or communicating with him in any way because he is forwarding everything to his "attorney".
Tell him you 'll sue him too ... and demand a restraining order which will stipulate he 'll have to stay 2000 pixels away from your characters.
Serious answer: He's full of , no he can't sue you for pking him
Can he sue me for saying stuff like: "RFLMFAOL Fail more, Bot more, Call you S clannies more" and other moronic stuff after killing him? lol

BUT if he did succeed in actually getting some idiotic judge and lawyers to take this on, it would be funny as hell to watch him get blown out of the water for the heftiest QQing ever!!!! I suggest you encourage him to go for it!!! :D

Now that I've been in the court system for a while, I can tell you that judges are looking at the virtual realm for things like this. It started because of the cyberbullying mom that resulted in the teenager killing herself (http://www.foxnews.com/story/0,2933,315684,00.html), (pardon the FoxNews link, it was convenient in my GoogleFu), and is now moving away from the social networks and into virtual worlds. SecondLife stands to see this coming soon, and I wager WoW and other MMOs will also start to see it happen.

This is the challenge, not that they will take it seriously, but that there is no precedence for this type of litigation... yet.
Virtual worlds face all the problems of the real worlds, and then add a heap more when you add in the competitive nature of MMOs and the secondary market advantage that caters to the type of people more apt to bring this type of litigation forward.
I actually am watching anxiously. I want to see how this goes. We are, for lack of a better term, in the Wild West all over again. The laws are still being written, overall.

Lol tell that guy to go for it and if he actaully sue you for harassment use this little game feature Player vs. Player Combat (http://www.lineage2.com/Knowledge/cp.html) thats what that guy agree to play so its his responsability anything inside the world of Lineage 2 including the mail is part of that world thus its something he can just walk away or just take it like a man
Was thinking back to some rule that NC, in their sole descretion, can stop players from harassing other players or griefing them...can't remember the exact words. I know some people got kicked from game on Aria for some harrasment i believe.

I think if you just PK him without the Epeen then you are within the spirit of the game so there should be no problem. However, none of us are lawyers.
You aren't stalking him or harassing him in any way. Player to Player contact is not against the rules in a Player Vs. Player game. If you are violating any of the game rules (ie - cursing or filling his inbox with illegitemate emails, etc) or something intentially melicious the game support is obligated to remove you (or at least "punish" you) as necessary. Also, because you aren't contacting him IRL he can avoid it by not logging in.
This is a PVP game. To me it sounds like someone trying to get you to leave them alone by scaring you. I'm just shocked it worked (or at least, that it almost worked).
Edit to add PS - if he goes to support they will probably just tell him to /ignore you unless you are spam making new alts to harass him. In that case they would temp (and if continued, perma) ban you.
I dont think GM's would care. I petitioned a bunch of farmers back in c1 or c2 for running off and stacking mobs on wall in toi5, and they told me they wont interfere with player vs player situations.
Ofc I told him a farmer stacking mobs on a wall has nothing to do with pvp, but he just closed the petition.
We ended up luring the mobs off the wall and killing them, forcing the farmer to eventually come up and pvp us to stop. We won.
This game seems to actually encourage bullying. Get a toon higher (by fair means or foul) and get top gear and show how strong you are by blowing legit players out of the water. This is how it works on Teon at least.
The game needs moderators to stop a) the cheating and b) the griefing. Unfortunately, L2 is barely moderated at all and hence all the problems.

Any decent attorney will laugh in his face after s/he hears the story. Of course he deserves this embarrassment. The only attorney who would touch his case would be a total nincompoop, in which case he will be represented by an idiot.
He could try to represent himself, bringing to mind the old saying "An attorney who represents himself has a fool as a client."

Seriously, all he can really do is report you to a GM, but then he risks his chat logs being reviewed also. Besides, how is he going to find you. He would have to get NcSoft to release their records. That should cost a pretty penny and time, lots of time.

You can kill the guy a million times in a week as far as the owners of the game are concerned--as long as you can find him and win and he's outside of safe zones. When I started it was common for enemies to try to roll one another repeatedly (it was always the case with 'KOS' status--what was intended anyway).
Two points:
be careful about your written in-game comments. NCSoft could decide that your words cross some imaginary line and hold you responsible depending upon what you put in your taunts. Years ago I killed a guy who sent me repeated filthy and foul (and blatantly racist/intolerant) notes--I forwarded them in a petition of course. So be careful you don't go too far out of bounds in what you right.
Secondly, of course he can sue you. You can sue me for typing this note if you want. I can sue "God" if I want. All he needs is some money and access to a lawyer who wants money (which is essentially all of them). Anyone 'can' sue anyone for anything--I think we've all seen this bar lowered to its current level of non-existence.
Will the case be heard in court? Will he win? Probably not to both--but you never know for sure.
You've gotten your pound (or two) of flesh and killed him repeatedly and gloated over and over. Accept that you won and move on now--my advice at least.
